Terms of Service for Sportmix

This document sets out the terms under which Sportmix (“the Service,” “we”) is provided. By visiting the website https://sportmixteam.com/ and placing an order, the user confirms that they have read and accepted these Terms.

1. Description of the Service
Online booking of training sessions. The user selects a suitable group (Standard, Premium, Kids) or personal coaching and books sessions at one of the Sportmix gyms.
Meal-plan delivery. The user orders a nutrition programme (Cutting 1200 kcal, Weight Loss 1500 kcal, Balance 2000 kcal, Muscle Gain 2500/3000 kcal) delivered on a fixed schedule.
The Service is available to both adults and minors without age restrictions; no account registration is required. All orders are confirmed by a manager via the contact details provided.

2. Ordering and Payment Procedure

• The user fills in the order form and clicks “Proceed to payment.”
• Payment is processed by Stripe at the time of ordering; currency — euro.
• After successful payment a confirmation screen is displayed and, if an e-mail address was provided, a receipt is sent.
• If the payment is declined, the user is redirected to an error page with instructions for retrying.

3. Pricing
Group programmes

• Standard: from €50 per month, at least one joint workout per week.
• Premium: €140 per month, at least two joint workouts per week.
• Kids: from €50 per month, at least one kids’ workout per week.

Personal coaching

• Starts at €120 for a tailored training and diet package.

Meal plans

• Weekly plans cost €135 – €150; the 20-day option is priced proportionally.

Payment is made via Stripe immediately upon placing the order.

4. Cancellation and Refund Policy

• Training sessions. Free cancellation up to 24 hours before the first session; later cancellations are non-refundable.
• Meal delivery. Free cancellation up to 48 hours before the next delivery; after that, the cost of meals already prepared is withheld.
• Refunds are issued via the original payment method within 14 calendar days.

5. Intellectual Property
All texts, logos, photos, training and nutrition programmes are the property of Sportmix. Any copying, distribution or commercial use without written permission is prohibited.

6. Prohibited Actions
The user must not provide knowingly false information, use third-party payment instruments without permission, interfere with the website’s operation, send spam, or violate intellectual-property rights. Sportmix reserves the right to cancel an order and block access without compensation if these rules are breached.

7. Disclaimer and Medical Notice
The Service is provided “as is.” Sportmix is not liable for indirect damages arising from use of the site. Physical exercise and dietary changes affect health; users should consult a physician before beginning any programme. Participation and diet compliance are at the user’s own risk.

8. Suspension of Access
We may temporarily suspend or permanently terminate services if the user violates these Terms, if required by law, or in cases of force majeure. Fees for services not yet rendered will be refunded proportionally, except where termination is due to the user’s breach.

9. Updates to the Terms
The current version is dated 5 June 2025. Users will be notified of material changes by e-mail at least 30 days before the new terms take effect.

10. Governing Law
These Terms are governed by the laws of Finland. Disputes are resolved through negotiation and, if necessary, in the competent courts of Helsinki unless imperative provisions state otherwise.

SportMix – Gym Membership Terms

1. Parties
These membership terms apply between SportMix (Business ID 3182859-9, Jauhokuja 3, 00920 Helsinki, Finland) and the Member.

2. General Information and Services Provided
SportMix offers guided and individual gym training, either through personal coaching or in groups. The training formats currently available are listed on the company website: www.sportmixteam.com.

3. Rights and Obligations of the Parties

• The Member undertakes to comply with the rules and regulations in force at SportMix gyms and to follow the instructions of trainers/coaches.
• SportMix is responsible for the proper functioning of equipment and for the qualifications and professionalism of its trainers and coaches.
• The Member is responsible for his/her own insurance coverage against personal injury and property damage. SportMix is not liable for any injuries the Member may sustain while in the gym.
• SportMix may, within reason, adjust training schedules (e.g. on public holidays) and will endeavour to announce such changes well in advance.

4. Membership Fee

• Current fees are published on www.sportmixteam.com.
• The membership fee must be paid no later than the 2nd day of each membership period. Absences do not entitle the Member to a full or partial refund.
• If the fee is not paid as required, SportMix may suspend services and deny access to the gym until the overdue amount is settled. SportMix may charge late-payment interest in accordance with Section 4 of the Finnish Interest Act.
• For Members under 18, the terms must be signed by a guardian, who is also responsible for all fees.

5. Changes to Membership
SportMix has the unilateral right to change its price list, range of services, membership fees or other terms. SportMix will notify the Member at least 60 days before the changes take effect; thereafter the changes apply automatically.

6. Validity of Membership

• Membership can be purchased via the website or at SportMix gyms.
• Membership is personal and non-transferable.
• SportMix organises groups and personal coaching on a calendar-month basis; membership therefore begins on the first day of a calendar month.
• Membership remains in force until terminated in writing.
• Termination must be e-mailed to sportmix.gym@gmail.com. The notice period is one month, counted from the last day of the calendar month in which notice is given.
• Example: if the agreement is signed in October, membership runs from 1 November and ends no earlier than 31 December, provided termination is submitted by 30 November.
• Membership may be suspended for health reasons by e-mailing SportMix a doctor’s or healthcare certificate stating the reason and duration of the break.

7. Other Terms

• SportMix is not responsible for theft or loss of personal property brought into the gym.
• SportMix is not liable for the Member’s inability to train, or for other temporary restrictions on the Member’s rights, when such interruptions are due to circumstances beyond SportMix’s reasonable control that could not have been foreseen or prevented (force majeure).
• SportMix stores member data in its information systems and processes personal data in accordance with the EU General Data Protection Regulation and other applicable data-protection laws. By purchasing a membership, the Member consents to the storage of his/her data in SportMix’s customer register. Information relating to membership is sent primarily to the e-mail or postal address provided by the Member.
• These membership terms are governed by Finnish law.
